Please read these Terms and Conditions carefully before using Pulse (“the Service”) operated by Pulse (“we”, “us”, or “our”). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

Pulse provides automated access to medical study content through licensed third-party platforms. Each session operates under a distinct, individually created, lawfully registered account subject to the third-party platform's own terms. Pulse does not circumvent paywalls through technical means; it purchases and manages trial or promotional access on users' behalf.

2. Eligibility

You must be at least 18 years old and capable of entering into a binding contract to use the Service. By registering you confirm that all information you provide is accurate and that you will keep it up to date.

3. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You must not share your account with others or allow simultaneous use by multiple people.
• You must not use automated tools, bots, or scripts to interact with the Service beyond what is expressly provided.
• We reserve the right to suspend or terminate accounts that we reasonably believe are being shared or abused.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to reverse-engineer, scrape, or otherwise extract data from the Service or third-party content accessed through it.
• Resell, sublicense, or otherwise commercialise your access to the Service without our express written permission.
• Interfere with or disrupt the integrity or performance of the Service.
• Use the Service in a manner that could harm, disparage, or create liability for us or any third party.

5. Payments & Subscriptions

• Payments are processed by Lemon Squeezy. By completing a purchase you also agree to Lemon Squeezy's Terms of Service.
• Day Pass grants 24 hours of paid access from the time of purchase confirmation.
• Monthly and Annual subscriptions renew automatically at the end of each billing period unless cancelled.
• All prices are shown in USD and are exclusive of any taxes that may apply in your jurisdiction.
• We reserve the right to change our pricing at any time with at least 7 days notice to existing subscribers.

6. Refund Policy

Due to the nature of the Service — which provides immediate digital access — all purchases are non-refundable unless required by applicable consumer protection law. If you believe a charge was made in error, contact us within 48 hours of the transaction at support@pulse.client-radar.org.

7. Service Availability

We strive for high availability but do not guarantee uninterrupted access. Scheduled maintenance, third-party outages, or circumstances beyond our control may cause temporary unavailability. We are not liable for any losses resulting from downtime.

8. Intellectual Property

All content delivered through the Service remains the intellectual property of its respective owners. Your subscription grants you personal, non-exclusive, non-transferable access for study purposes only. You may not reproduce, redistribute, or create derivative works from the content.

9. Privacy

We collect only the information necessary to provide the Service (email address, hashed password, IP address for abuse prevention, and subscription status). We do not sell your personal data to third parties. Payment information is handled exclusively by Lemon Squeezy and is never stored on our servers.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data or profits, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages. Our total liability for any claim shall not exceed the amount you paid us in the 30 days preceding the claim.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice in the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction, as determined by us at our sole discretion.
